Terms and conditions:

1. Definitions:

• Platform: referrers to the iwannacamp website
• User, You: referrers to an individual using the platform
• Host: referrers to campsite owners/operators listing their properties
• Booking: means a confirmed reservation for a campsite through the platform

2. Consumer rights:

These Terms are subject to the Consumer Protection Act, 68 of 2008 (“CPA”). Nothing in these Terms limits your legal rights as a consumer under South African law.

If any provision conflicts with the CPA, such provision will be interpreted to give effect to the CPA.

3. Electronic Communication & Contracting:

In accordance with the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”):

• You agree to receive communications electronically.
• A valid contract is formed when you complete a booking and receive confirmation from iwannacamp.
• Records of transactions will be maintained and are available upon request.

4. Eligibility:

• You must be at least 18 years old and capable of forming a legally binding contract to use our services

5. Account registration:

• You may need to create an account to access certain features
• You are responsible for keeping your login credentials secure
• You agree to provide accurate, current and complete information

6. Booking process:

• Users can view campsite listings, check availability and make reservations
• Bookings are subject to Host acceptance and availability. Subject to change due to any conditions, e.g. weather, flooding, maintenance etc
• You agree to pay all fees, including service charges and applicable taxes

7. Cancellation and refunds:

• Cancellation policies vary by Host and are listed on each booking page.
• Refunds, if applicable, will be processed according to the stated cancellation policy and should be discussed with Host directly
• iwannacamp will charge a 15% non-refundable service/booking fee

8. User responsibilities:

You agree not to:

• Use the platform for illegal activities
• Post males, misleading or inappropriate content
• Harm or harass other users or Hosts
• Circumvent our booking process or fees

9. Host responsibilities:

• Hosts must provide accurate information about their campsite
• Hosts are responsible for maintaining the property and honouring bookings
• Hosts must comply with all relevant laws, licenses and safety regulations

10. Limitation of liability:

iwannacamp acts as an intermediary platform and is not a party to the agreement between Users and Hosts. We are not liable for:

• Acts or omissions of Hosts or Guests
• Cancellation, delays or force majeure events
• Damages or losses arising from your use of the platform

11. Intellectually property:

All content on the Platform (logos, text, graphics, software) is owned by or licensed to iwannacamp. You may not copy, distribute or modify any part of the site without permission.

12. Termination:

We reserve the right to suspend or terminate your account if you breach these terms, misuse the platform or engage in harmful behaviour.

13. Governing Law:

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

In the event of any dispute arising from or in connection with these Terms, you agree to submit to the exclusive jurisdiction of the courts of South Africa, specifically the High Court of South Africa, unless otherwise agreed between the parties.

If any provision of these Terms is found to be invalid or unenforceable under South African law, such provision shall be severed from the remaining terms, which shall remain valid and enforceable.

14. Changes to these terms:

We may update these Terms occasionally. Continued use of the platform constitutes acceptance of the revised terms.
